1. Who we are
Hero Merch (heromerch.co.uk) is a trading style of Smarter Sites Ltd, a company registered in England and Wales (company no. 14570248). You can contact us at [email protected]. These terms apply when you use our website or buy anything from us — by creating an account or placing an order you agree to them.
2. What we sell
We turn a photo you upload into AI-generated superhero artwork, and print that artwork onto garments (t-shirts, hoodies and sweatshirts) which we make to order and deliver within the United Kingdom. Every product is personalised and made specifically for you — nothing is held in stock.
3. Your account
- You need a free account to generate artwork and place orders. You're responsible for keeping your password safe and for activity on your account.
- You must be at least 18 to create an account and place orders. Children can be the subject of artwork, but the account holder must be an adult with the right to use the photo (see section 4).
- Fair use: free artwork generation is limited per day. We may suspend accounts that attempt to abuse, automate or overload the service.
4. Photos you upload
- You must own the photo or have permission from everyone shown in it (and, for children, from their parent or guardian) to use it here.
- Don't upload photos that are unlawful, or that depict anyone who hasn't consented. We may remove content and suspend accounts that break this rule.
- You keep ownership of your photo. You give us the limited permission we need to process it — creating your artwork, quality-checking it and printing your order (see our Privacy Policy for exactly how photos are handled).
5. Your artwork
- Artwork is generated by AI. Results vary — that's part of the fun — and each design is quality-checked before you can order it. Previews are shown with a watermark; the printed product never carries the watermark.
- You may buy products featuring your artwork for personal, non-commercial use. All characters are original creations; any resemblance to existing fictional characters is unintended, and we don't accept requests to reproduce copyrighted characters.
- We may keep your generated artwork in your account so you can reorder it. You can delete artwork from your account at any time.
6. Orders, prices and payment
- All prices are shown in pounds sterling. UK delivery is a flat £3.99 per order unless stated otherwise at checkout.
- Payment is taken securely by Stripe at checkout. We never see or store your card details.
- Your order is accepted when we email confirmation after successful payment. In the unlikely event we can't fulfil an order (for example a garment becomes unavailable), we'll refund you in full.
7. Delivery
Products are printed to order in the UK and typically arrive within 3–7 working days of purchase. We currently deliver to United Kingdom addresses only. If your order is significantly delayed, contact us and we'll chase it or put it right.
8. Returns, faults and our guarantee
Because every product is personalised to you, the usual 14-day change-of-mind cancellation right under the Consumer Contracts Regulations 2013 doesn't apply to made-to-order personalised goods. But you're fully protected where it matters — see our Delivery & Returns policy, including our free-reprint guarantee for any order that arrives damaged, misprinted or not matching your approved preview. Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.
9. Our liability
We're responsible for foreseeable loss caused by our breach of these terms, up to the amount you paid for the order concerned. We don't exclude anything the law doesn't let us exclude (like liability for fraud). We are not liable for delays or failures caused by events outside our reasonable control.
10. The service
We work hard to keep the site available, but it's provided "as is" and we can't promise it will be uninterrupted. We may update, change or withdraw features (including the daily free generation allowance) at any time.
11. General
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If any part of these terms is found unenforceable, the rest still applies. We may update these terms from time to time; the version on this page applies to your order.
